Method 1 Controlling Voice or FaceTime Calls

Most shippings to stores are well protected, so they should offer you a replacement set.     One, you may not have allowed them to access the phone (setting -> general-> accessabilty->hearing. Scroll to the bar with the letter on each side and make sure the ball is in the middle). Two, the headphones could be damaged. Three, the headphones might not be plugged in all the way. Four, it could just be a random malfunction that resolves itself when you restart the phone.
